QUESTIONS ON THE ARCHITECTURE AND ENGINEERING OF THE CONSTITUTIONAL CHAMBER OF VENEZUELA’S SUPREME COURT OF JUSTICE

RESUMEN: Recientemente la Sala Constitucional del Tribunal Supremo de Justicia venezolano, ha dictado decisiones en casos políticos de relevancia nacional los cuales han determinado el destino de la democracia del país. Los casos de la Asamblea Nacional, del Estado de Excepción y Emergencia Económica y de la Asamblea Nacional Constituyente, son los más resaltantes debido a su incidencia en la institucionalidad que persigue la Constitución de 1999. En esos asuntos, la Sala Constitucional ha asumido y redistribuido competencias de los demás poderes públicos e incluso ha suprimido totalmente al Poder Legislativo, ello, con base en el ejercicio de la competencia relativa a la interpretación con efecto vinculante el contenido y alcance de la Constitución, que puede ser considerada una innovación debido al cambio en el entendimiento que se tenía en el país respecto de las fuentes del Derecho pero no la primera recepción en el ordenamiento jurídico venezolano de institutos propios del Common Law. Ahora bien, antes de afrontar el tema relativo a la teoría de los precedentes en Venezuela, es preciso poner atención a otros puntos previos e indispensables para su construcción, esto es, la integración (cantidad de jueces, forma de ingreso, duración de los jueces en el cargo y organización para la distribución de tareas) y el modo de funcionamiento para la producción y comunicación de sentencias (admisión, deliberación, decisión y publicación), lo que debe adecuarse al modelo de precedentes que encuentra sustento en el artículo 335 de la Constitución de 1999, a estos aspectos se les denomina arquitectura e ingeniería de la Sala Constitucional del Tribunal Supremo de Justicia de Venezuela.

ABSTRACT: Recently, the Constitutional Chamber of the Venezuelan Supreme Court of Justice has issued decisions in political cases of national relevance which have determined the fate of the country's democracy. The cases of the National Assembly, the State of Exception and Economic Emergency and the National Constituent Assembly, are the most outstanding because of their impact on the institutions pursued by the 1999 Constitution. In those cases, the Constitutional Chamber has taken over and redistributed powers of the other public powers and even has completely abolished the Legislative Power, this, based on the exercise of jurisdiction over the interpretation with binding effect the content and scope of the Constitution, which can be considered an innovation due to the change in the understanding that was had in the country with respect to the sources of the Law but not the first reception in the Venezuelan legal system of institutes of the Common Law. However, before addressing the issue related to the theory of precedents in Venezuela, it is necessary to pay attention to other previous and essential points for its construction, that is, integration (number of judges, form of income, duration of judges in charge and organization for the distribution of the work) and the mode of operation for the production and communication of judgments (admission, deliberation, decision and publication), which must be adapted to the model of precedents found in article 335 of the Constitution of 1999, these aspects are called architecture and engineering of the Constitutional Chamber of the Supreme Court of Justice of Venezuela.
