História da evolução do direito humano à água

RESUMO
A água é um recurso fundamental para a subsistência humana. Todavia, apesar da sua reconhecida importância, durante muitos anos houve uma tendência de trata-la simplesmente como um bem económico. Atualmente, o cenário é outro e diga-se, melhor: a água é vista como um bem econômico, sim, mas também como um direito humano. Entretanto, a qualificação da água como direito humano não significa que a mesma deve ser garantida imediata e gratuitamente. Por outro lado, sendo a mesma um direito humano, surge a questão de saber quem e como deve garantir a satisfação de tal direito. Mais ainda, sendo a água um bem econômico, que se compra e vendese, pode parecer paradoxal que a mesma seja considerada um direito humano. Pelo que, um esclarecimento da natureza e dinâmica deste direito é curial, numa altura em que se fala da possibilidade de ocorrência de guerras pela água.

ABSTRACT
Water is a fundamental resource for human subsistence. However, despite its importance, for many years it was treated simply as an economic good. Nowadays the approach is different, and, let’s say, better: water is still regarded as an economic good, yes, but also as a human right. Meanwhile, the qualification of water as a human right does not mean that it must be provided immediately and at no cost. On the other hand, being water a human right, questions such as who and how must satisfy such right arise. Moreover, being water an economic good, which is sold and bought, it may seem paradox that is considered a human right. So, a clarification on the nature and dynamics of such right is curial, in times which discourses on water wars are common.
