Resumo

O stalking é um crime que se baseia num padrão de múltiplas condutas de diferentes espécies que se concretizam em variados atos da mesma natureza e que têm em comum o facto de corresponderem a uma manifestação de assédio e de perseguição da vítima, os quais são adotados de forma reiterada e persistente. Alguns estudos têm vindo a demonstrar que a aplicação de uma pena pode não produzir efeitos relevantes no stalker, acabando este por ter comportamentos reincidentes. Deste modo, o presente artigo visa realizar uma abordagem reflexiva sobre a possibilidade de conjugação do tratamento psicológico com a pena aplicada, de modo a minimizar a possível reincidência.
