ABSTRACT: The decades from 1960 to 1980 have been branded in the recent history of Brazil and Argentina due to the civil-military governments based in the National Security Act, which installed the culture of fear in one State characterized by the lack of democracy, by political persecutions and censure.  Within this context many state agencies were strengthened or created to monitor and investigate citizens that were opposed to the political system of the time. On the other hand, these security agencies were, in some cases, bureaucratized and as a consequence produced many documents that currently formed the archives of repression. With the end of the civil-military governments these archives became an important tool in the construction of the right to the truth, memory and justice. Therefore, this research aims to present the laws of archive that assist in the secrecy and in the access to information contained in these archives that present the participation of the State in the human rights violations crimes.
